Basic Function:
Primarily responsible for the evaluation, negotiation and resolution of PIP litigation involving arbitrations and suits. Manage litigation process through disposition of claim and continue to adjust all aspects of the PIP file.
Major Responsibilities:
- Maintain claim files, evaluate claim using facts and supporting data on jurisdiction and injury, document records as case proceeds.
- Update appropriate parties as needed, providing new facts as they become available, and their impact upon the liability analysis and settlement options.
- Verify the nature and extent of injury by obtaining and reviewing appropriate medical records and documentation.
- Recognize and implement alternate means of resolution.
- Develop and implement negotiation strategy.
- Select defense counsel, complete suit transmittals and direct litigation.
- Develop litigation plan with defense counsel and tract adherence to plan in order to control legal expenses and assure effective resolution. Review and evaluate all incoming bills before payment.
- Attend depositions, mediations, arbitration, pretrial, trials and all other legal proceedings, - needed.
- Maintain appropriate inventory within specified goals/guidelines.
Knowledge/Qualification/Experience:
- Business Knowledge/Systems Management
- Problem Solving / Decision Making
- Working knowledge of all computer systems currently being used
- Knowledge of PIP rules and regulations
- Negotiation Strategies
- Reserving Practices
- Generally 3 - 5 years of PIP/ Bodily injury adjusting experience. Litigation experience is helpful
- A four year degree or commensurate business experience
